Personal Injury Results
Rear End Accident: $300,000 Settlement (Policy Limits)
Client was driving her vehicle and came to a complete stop in Redlands, CA. A driver of a truck was not paying attention and rear ended the Client's vehicle. Client sustained lumbar spinal cord injuries and underwent surgery after chiropractic care, orthopedic care, and a series of epidural lumbar injections. Client also sustained substantial lost wages. The medical bills were substantial. However, the bills were negotiated down to a fraction of what she owed so that she was left with much more in her pocket. The original offer by the insurance company was under $20,000.
Family Law Results
Client had been representing herself and the case was not going well. She had allowed the minor children to visit their father in Las Vegas, Nevada. The father was supposed to bring the minor children back before the school year started. The father refused to bring the minor children back and enrolled them into school in Las Vegas, Nevada. To make matters worse, the client went to mediation through Family Court Services who recommended that the father have full custody. At trial it was proven that the father had a serious criminal record and a history of abuse upon the mother. Father was not able to rebut the presumption under California Family Code section 3044 that he should not have custody. Client was awarded full custody.
Client had not been actively involved in his nine (9) year old son's life. He was not doing well in his mother's care and was taunted and bullied by the occupants of the home. Client filed a request for order and was awarded full custody. His child support was reduced to zero.
Client was supposed to have summer visitation with his two teenage children that lived out of state. The mother of the children refused to follow court orders. Father also had an increase in income and was set to pay substantially more in child support. Client filed a request for order and rather than fight the request, the mother stipulated to give client full custody. Client child support was reduced to zero.
Child Support Arrears
Clients child support arrears of over $70,000 were waived.
Multi-State Custody Battle (UCCJEA)
Client lived in San Bernardino, CA with his girlfriend and daughter. After breaking up with his girlfriend moved to Las Vegas with the minor child and refused to allow visitation or return. Client filed request for order. Judge demanded that the child be brought back to California and granted joint custody. After another hearing, the judge granted full custody to client.
Stepparent Adoption-Termination of Rights
Clients were husband and wife. They wanted to terminate the parental rights of the biological father and have the stepdad be ruled as the legal parent. After trial, parental rights were terminated and the stepparent adoption was granted because there was a close-father son relationship and other legal requirements were met.
Client had ex-girlfriend who unfortunately passed away and left a minor child. Client was not the father of the minor child. The paternal grandfather of the minor child sought for custody arguing that the client was not the biological father and was not related to the minor child. After trial, the court ruled that a strong parent-child relationship had been formed and granted the guardianship request.
Client sought full custody of the minor child alleging abuse by the father. The court granted clients request for full legal and physical custody.
Spousal Support Modification
Client was orders to pay $2,500 a month in spousal support. Client filed a request for order to modify spousal support and the court reduced the monthly support to $500.
Client sought a restraining order from her abusive significant other. There were multiple minor children. Court granted the restraining order and suspended all visitation. Client was granted full custody. Father was ordered to complete anger management and other programs before resuming visitation.
